Terms of Service

warmUP is a PC game launcher and library client, currently in pre-launch. This Site lets you join a waitlist for early access and the free download, view planned subscription plans, and learn about our creator/reward program.

We may add, change, delay, suspend, or remove features, pricing, or the launch date at any time. Plans, prices, and rewards shown on this Site are subject to change before launch.

Joining the waitlist does not guarantee access by any specific date, and does not create any purchase obligation. We may use your email to notify you about launch, pricing, and the creator program.

The creator program ("Make a Reel, get warmUP for free") lets you earn a discount or free access to the warmUP Plan by posting a public Reel about warmUP on Instagram or TikTok, tagging us, and using #warmUP. Reward tiers are based on organic view counts as described on the Creators page at the time of your submission.

• Views must be organic — no bots, paid promotion, or view manipulation.
• We may verify view counts, account authenticity, and content before granting any reward.
• We may decline rewards for suspicious activity, fake engagement, or content that violates these Terms.
• Rewards are applied as discounts or free periods on the warmUP Plan and have no cash value.
• The program, its tiers, and rewards may be changed or withdrawn at any time, including after a Reel is posted but before a reward is claimed.
• By submitting a Reel, you confirm you own or have rights to the content, and you grant us permission to view, reference, and (with credit) showcase it for promotional purposes related to warmUP.

Paid plans, when available, will be offered through Stripe Checkout. Prices, billing periods, features, renewal terms, taxes, refunds, and cancellation rules will be shown in the checkout flow at the time of purchase. Pricing shown on this Site before launch is indicative and may change.

Cancellation and automatic renewal. You can cancel a paid plan at any time. After the initial billing period, the contract continues for an indefinite term and can be terminated at any time with a notice period of no more than one month. Full details are in our Cancellation & Withdrawal Policy.

Right of withdrawal (EU/EEA consumers). If you are a consumer in the EU/EEA, you have the right to withdraw from a purchase within 14 days of concluding the contract, without giving reasons. For paid digital content and services, that right expires early only if you expressly requested immediate performance, expressly acknowledged that you thereby lose the right of withdrawal, and received our confirmation of that on a durable medium. The withdrawal instructions, the model withdrawal form, and the effects of withdrawal (including reimbursement within 14 days) are set out in our Cancellation & Withdrawal Policy. This does not affect mandatory statutory cancellation rights.

warmUP integrates with third-party services, including Supabase, Stripe, Cloudflare, Discord, Steam, Epic Games, GOG, Amazon Games, Instagram, and TikTok. Your use of those services may be subject to their own terms and policies. We do not control third-party services and are not responsible for their content, downtime, or policy changes.

You agree not to misuse the Service, including by violating law, infringing intellectual property, submitting unlawful content, attempting to manipulate the waitlist or creator program, scraping or attacking our infrastructure, or interfering with other users.

The Site, App, warmUP branding, UI, and original content are owned by us or our licensors. Subject to these Terms, we grant you a personal, non-exclusive, non-transferable, revocable license to use the Service for its intended purpose. Game titles, logos, and third-party assets remain property of their respective owners.

The Service is provided "as is" and "as available." To the maximum extent permitted by law, we disclaim all warranties, express, implied, or statutory, including merchantability, fitness for a particular purpose, non-infringement, availability, and accuracy — including the launch date, pricing, and features described on this Site before official launch.

To the maximum extent permitted by law, we and our affiliates will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost data, or lost goodwill arising from your use of the Service. Our total liability for any claim related to the Service shall not exceed the greater of amounts you paid us in the twelve months before the claim or US $50, except where law does not allow that limit.

Mandatory law carve-out. Nothing in these Terms limits or excludes liability that cannot be limited or excluded under applicable mandatory law. In particular, for users subject to German law, the disclaimers and limitations above do not apply to liability for intent or gross negligence, for injury to life, body, or health, under the German Product Liability Act (Produkthaftungsgesetz), under any guarantee we expressly give, or for breach of essential contractual obligations (Kardinalpflichten); for slightly negligent breach of essential contractual obligations our liability is limited to the foreseeable damage typical for this type of contract.

To the extent permitted by applicable law, you agree to indemnify, defend, and hold harmless warmUP, its owner, affiliates, contractors, and licensors from and against any third-party claims, demands, proceedings, damages, losses, liabilities, fines, and reasonable costs (including legal defence costs) arising out of or in connection with your culpable breach of these Terms, the content you submit (including creator-program Reels and link suggestions), your violation of the rules of a connected third-party service, your violation of applicable law, or your infringement of third-party rights.

This obligation does not apply to the extent the claim is caused by us, and for consumers it applies only to the extent mandatory law permits — it does not create liability beyond what statutory law already provides. We will notify you of any claim for which we seek indemnification and will not settle it without your consent where your consent is legally required.

How we handle personal data, how long we keep it, and how to have it deleted is described in our Privacy Policy. You can request deletion of your profile and personal data at any time through our data deletion form — without logging in — or, if you use the desktop app, under Settings → Privacy → Delete account. Verified deletion requests are completed within 30 days, except where retention is required by law. Deleting data does not by itself cancel a paid plan; to end a subscription use the cancellation form.

We may update these Terms by posting a new effective date on this page. Continued use of the Service after changes means you accept the updated Terms unless applicable law requires additional notice or consent.

Except where mandatory consumer protection law in your country of residence requires otherwise, these Terms are governed by the laws of Germany, excluding conflict-of-law rules. Venue for commercial disputes shall be the courts of Berlin, Germany, where permitted. Consumers may bring claims in their place of residence where EU or national law so requires.
